Any projections, estimates, forecasts, or performance expectations provided by SSW Traders are for informational and planning purposes only and are not guarantees of future results.

Advertising budgets paid to platforms such as Google, Meta, TikTok, or other third-party platforms are separate from SSW Traders’ service fees unless expressly stated otherwise.

5. Third-Party Platforms

Our services may depend on third-party platforms and services, including search engines, advertising networks, social media platforms, hosting providers, analytics services, payment processors, and software providers.

This may include loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings.

To the maximum extent permitted by applicable law, SSW Traders’ total liability arising from a specific service or claim will not exceed the amount actually paid to SSW Traders for the specific services giving rise to the claim during the applicable period, unless a written agreement provides otherwise.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

10. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless SSW Traders, its owners, employees, contractors, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

  • The client requests unlawful or prohibited activities
  • Continued service would create a significant legal, security, or reputational risk

Termination does not eliminate payment obligations for services already performed or expenses already incurred.

These links are provided for convenience only. SSW Traders does not control and is not responsible for the content, availability, security, or policies of third-party websites.

While we make reasonable efforts to keep information accurate and current, we do not guarantee that all website content will always be complete, accurate, current, or free from errors.

We may modify, update, suspend, or discontinue portions of our website at any time without prior notice.

SSW Traders will not be responsible for delays or failures in performing its obligations when caused by circumstances beyond its reasonable control.

Such circumstances may include natural disasters, internet or telecommunications failures, government actions, labor disputes, cyber incidents, widespread platform outages, acts of war, or other events that could not reasonably have been prevented or controlled.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the applicable laws of the United States and, where applicable, the laws of the state with jurisdiction over the applicable transaction or dispute, without regard to conflict-of-law principles.

Any dispute arising from these Terms or our services should first be addressed through good-faith communication between the parties.

Where required or permitted by applicable law, disputes may be resolved through an appropriate court or alternative dispute-resolution process having proper jurisdiction.

Nothing in this section is intended to deprive a consumer of rights or protections that cannot legally be waived under applicable U.S. federal or state law.

16. Changes to These Terms

SSW Traders may update these Terms from time to time to reflect changes in our services, business practices, technology, or applicable legal requirements.

Updated Terms will be posted on this page with the revised “Last Updated” date.

Your continued use of our website or services after an update becomes effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

These Terms, together with any applicable proposal, quotation, statement of work, service agreement, invoice, or other written agreement between SSW Traders and the client, constitute the agreement governing the applicable services.

If there is a conflict between these Terms and a separately signed written service agreement, the terms of the signed service agreement will control to the extent of the conflict.
